
Promotional material
When you promote your Mobloom video, there are certain rules you have to comply with.
The rules are described in details by ICSTIS in their "Code of Practice" which can be found on their website www.icstis.org.uk. You have the sole responsibility to comply with the rules in the “Code of Practice” and therefore we recommend that you read it. However, we have listed a summery of the main rules in a way that provides you a good overview of it all. If you have any doubts about the legitimacy of your promotional material we suggest you read the full set of rules provided at the above link.
Clearly state the price of your videos
We recommend that you, in all your promotional material, state how much you are charging for your video download. However, Mobloom ALLWAYS include the price of the video in the beginning of the initial SMS (the one the downloader gets immediately after requesting your video, which he must agree to, to be able to get the video). The user will never be presented with a SMS containing a download link from Mobloom unless there is a price in it as well.
Be honest
Be honest and do not advertise your video for being anything else than it is. If you market something that you do not provide, people are entitled to complain (and they will do that) which can result in your Mobloom account being deactivated, you not getting any money and if your content breaks any law maybe even face prosecution.
Contact details
You are obligated to provide address information so that people downloading your video can get hold of you. You must make sure you provide your name or the name of your company and supply at least one of the following contact options: Full postal address, a Post box address or the phone number to a telephone helpline.
Pricing
If you advertise your videos through TV and you price them at more than £2.00, they must be both written as well as they have to be read out to the viewer. Letters must be big and easy to read, the voice must be clear and easy to understand.
Subscription
When someone has signed up to your newsletter, tell them how they can stop receiving it. They can do this by texting the word “stop” to the Mobloom short code.
Content
All the above rules about the kind of material you are not allowed to have in your video (like violence, racism, sex etc.) also apply to your promotional material.
Target group
Determine your target audience and make sure the material promoted to them is suitable for them. This goes especially if you are promoting anything to children or minors. Any marketing relating to alcohol, tobacco, medicines, diet products, gambling services or products, cosmetic surgery or adult products is not allowed to under 18s.
